Congratulations, Almichev! You've progressed thru all the Stages of Pendragon quite quickly. A few are still stuck at stage 3... not naming any names. .Lol. I've gotta see the Asylum one yet, not bothered at the moment though. Don't think i could handle another cheapo version of a book that should be filmed with a decent budget and alot of care for the story and atmosphere.

Hallmark wanted to do a version of WOTW. It probably would have been an authentic adaptation. Paramount took them to court and stopped it. I think it's most likely BBC hasn't done an adaptation for the same reason.
Based on what Charles has said, I *think* that when the UK copyright runs out, this will make it possible for anyone who wants to make their own version, so long as it's based directly on Wells' novel and not on one of the two Paramount movies. Actually, I think Charles has said anyone can currently make a film version based on Wells' original novel here in the states, but couldn't market it overseas in countries where Wells' copyright is still in force-- such as the European Union. This appears to be the approach Pendragon used, despite an early claim by them which seemed to suggest Paramount had sent them a letter granting permission. Note Pendragon's website for their DVD says it can't be shipped to the EU.
But again: I am not an intellectual properties lawyer, I'm not sure of the facts, and no one thinking of making a WOTW film should rely on what I've said.

I think it's most likely BBC hasn't done an adaptation for the same reason. Actually it was Hallmark that sued Paramount for a declaration of rights in 2002. The verdict in the case found that the original language used by Wells's son in signing over motion picture rights to Paramount was sufficiently broad as to allow them first refusal rights regarding TV movies, and effectively stopped Hallmark from producing their mini series.
