I saw the movie, and thought it was all right as an alien invasion film, but it had almost nothing to do with WOTW outside of the title. I was disappointed that the aliens weren't Martians.

The more I look at it, the more it could be classed as a remake of the 1953, because it has more in common with that. Such a thing seems to make sense, well in my mind anyway!

Yes, that's my opinion too. It's not the book, but a remake of the '53 movie....
The movie has got a few good scenes, like the people fighting for the car, the Tripod that crushed the trees when it came over the hills towards the ferry and I also liked the Dead London like scenes with the Tripod crashed into the building.
It was on Dutch television a few days ago so I watched it. But although I got in on DVD, it's not a movie I would put into my DVD player while enjoying a cold beer...

I think to the 53 movie. For example: The entire sequence in the basement of the house with the tentacle/probe eye entering the room and then the aliens themself, is directly from the 53 movie.

Yes. I also found the film a lot easier to accept as a remake of the old movie instead of a WotW film.
Didn't the two leads from the '53 film make a cameo?

Yeah that's right. Gene Barry and Ann Robinson can be seen as the parents of Ray's ex-wife, at the end of the movie when Ray arrives in Boston.

Oh yes! despite what people say, there are loads of scenes in the film that are in the book. And Spielberg included scenes that Wells only briefly mentioned such as the burning train.

I thought that scene was hilarious. All just standing there as a full speed burning trail raced past. All i saw was Monty Python: RUNAWAY! RUN AWAY! ;D

Another scene is the intersection where we see the first tripod. As the ground starts cracking we see it moving as well. We then go to an overhead view and see that the ground is actually rotating. And I'd estimate the intersection to be about 30 yards wide. What could be happening I wonder? There's all kinds of connections to the book in the movie. You just have to look really hard to find them.

And there is the panic in the streets scene where people are fleeing from the Martians Aliens. That is very much as Wells described 'The Exodus from London' and the mob attacking the car is similar to the assault on Mrs Elphinstone and her sister-in-law in their chaise, although the end result is different.
